RESUMO: Neste tra­bal­ho, será anal­isa­da a questão da apli­cação dos diál­o­gos inter­cul­tur­ais aos dire­itos humanos, prin­ci­pal­mente acer­ca da her­menêu­ti­ca diatópi­ca de Rai­mon Panikkar, e como isto reper­cu­tiu na Antropolo­gia Jurídi­ca francó­fona. O méto­do uti­liza­do será o lev­an­ta­men­to bib­li­ográ­fi­co sobre o tema. Serão abor­dadas obras da Filosofia, da Soci­olo­gia e da Antropolo­gia do Dire­ito que tratam do diál­o­go inter­cul­tur­al nos dire­itos humanos, a her­menêu­ti­ca diatópi­ca e o plu­ral­is­mo jurídi­co de for­ma cen­tral ou reflexa. Este tra­bal­ho está divi­di­do em duas partes. Na primeira parte será apre­sen­ta­da a abor­dagem inter­cul­tur­al dos dire­itos humanos e na proposição de Panikkar de se uti­lizar a her­menêu­ti­ca diatópi­ca como méto­do para a real­iza­ção de diál­o­gos entre o topos oci­den­tal dos dire­itos humanos e topoi de out­ras cul­turas. Na segun­da parte, serão apre­sen­ta­dos tex­tos de Robert Vachon e Boaven­tu­ra de Sousa San­tos que tra­bal­ham o con­ceito de her­menêu­ti­ca diatópi­ca. Logo após, serão apre­sen­tadas as influên­cias que estas obras de Panikkar, Vachon e San­tos na Antropolo­gia Jurídi­ca francó­fona, par­tic­u­lar­mente nas obras de Éti­enne Le Roy e Christoph Eber­hard.

ABSTRACT: In this work, it’s going to be ana­lyzed the ques­tion of the appli­ca­tion of inter­cul­tur­al dia­logues to human rights, spe­cial­ly on Rai­mon Panikkar’s diatopi­cal hermeneu­tics, and how this impact­ed on fran­coph­o­ne Legal Anthro­pol­o­gy. The applied method will be the bib­li­o­graph­ic sur­vey on the top­ic. It’s going to be ana­lyzed works of Phi­los­o­phy, Soci­ol­o­gy and Legal Anthro­pol­o­gy which deal cen­tral­ly or reflex­ive­ly with inter­cul­tur­al dia­logue in human rights, diatopi­cal hermeneu­tics and legal plu­ral­ism. This work is divid­ed into two parts. In the first part, the inter­cul­tur­al approach to human rights will be pre­sent­ed and Panikkar’s pro­pos­al to use diatopi­cal hermeneu­tics as a method for con­duct­ing dia­logues between the west­ern topos of human rights and the topoi of oth­er cul­tures. In the sec­ond part, it’s going to be pre­sent­ed texts by Robert Vachon and Boaven­tu­ra de Sousa San­tos that work with the con­cept of diatopi­cal hermeneu­tics. Soon after, the influ­ences that these works by Panikkar, Vachon and San­tos will have on fran­coph­o­ne Legal Anthro­pol­o­gy, par­tic­u­lar­ly in the works of Éti­enne Le Roy and Christoph Eber­hard.
