RESUMO: A função trans­for­mado­ra Con­sti­tu­cional é essen­cial para as imple­men­tações dos mecan­is­mos e fer­ra­men­tas da justiça de tran­sição, a fim de pro­mover a con­strução da paz sus­ten­táv­el para as trans­for­mações das estru­turas insti­tu­cionais, políti­cas, econômi­cas e soci­ais no Brasil, após a tran­sição de regimes. Nesse con­tex­to, a inter­pre­tação con­sti­tu­cional assume uma mis­são impor­tante na real­iza­ção das funções da Con­sti­tu­ição, seus val­ores e nor­mas, além de pro­por­cionar aplic­a­bil­i­dade práti­ca das refor­mas para as trans­for­mações do Esta­do, das insti­tu­ições e da sociedade.

ABSTRACT: The Con­sti­tu­cional trans­for­ma­tive func­tion is essen­tial for the imple­men­ta­tions of the mech­a­nisms and tools of the tran­si­tion­al jus­tice, in order to pro­mote the con­struc­tion of the sus­tain­able peace for the trans­for­ma­tions of the insti­tu­tion­al, polit­i­cal, eco­nom­ic and social struc­tures in Brazil, after the tran­si­tion of regimes. In this con­text, con­sti­tu­tion­al inter­pre­ta­tion assumes an impor­tant mis­sion in real­iz­ing the Con­sti­tu­tion func­tions, its val­ues and its norms, as well as pro­vid­ing prac­ti­cal applic­a­bil­i­ty of the reforms for the trans­for­ma­tions of the State, insti­tu­tions and soci­ety.
