RESUMO: Este tra­bal­ho tem por escopo anal­is­ar as con­se­quên­cias da respon­s­abi­liza­ção inter­na­cional do Esta­do Brasileiro no caso Cosme Rosa Gen­ove­va, mais con­heci­do como caso Favela Nova Brasília. Ini­cial­mente, será estu­da­da a vio­lên­cia poli­cial e a necrop­olíti­ca no Brasil, em ger­al, e no Esta­do do Rio de Janeiro, em par­tic­u­lar. Ato con­tín­uo, será real­iza­do um breve aporte históri­co acer­ca da adesão do Brasil ao Sis­tema Inter­amer­i­cano de Dire­itos Humanos. Por fim, pro­ced­er-se‑á à análise do Caso Favela Nova Brasileira e de alguns reflex­os da juris­dição con­tenciosa da Corte Inter­amer­i­cana de Dire­itos Humanos no orde­na­men­to jurídi­co inter­no.

ABSTRACT: This essay aims to ana­lyze the con­se­quences of Brazil’s con­dem­na­tion in the Case of Cosme Rosa Gen­ove­va, also known as the Case of Favela Nova Brasília. Ini­tial­ly, the arti­cle presents a gen­er­al per­spec­tive on police vio­lence and necrop­ol­i­tics in Brazil, in order to advance on a detained study of these phe­nom­e­na in the city of Rio de Janeiro. Next, Brazil’s acces­sion to the Inter-Amer­i­can Sys­tem for the Pro­tec­tion of Human Rights will be his­tor­i­cal­ly con­tex­tu­al­ized. Final­ly, we review the Case of Favela Nova Brasília, intro­duc­ing some reflec­tions on the con­tentious juris­dic­tion of the Inter-Amer­i­can Court of Human Rights with­in the domes­tic legal sys­tem.
