RESUMO: O Pro­to­co­lo de Paler­mo de 2000 e o Convênio de Istam­bul de 2011 per­tencem à con­tem­po­ranei­dade e comungam de ideais democráticos, por­tan­to, mere­cem uma análise do pon­to de vista do Dire­ito Inter­na­cional e do Dire­ito Comunitário, neste estu­do, quan­to às garan­tias ofer­e­ci­das pelos Esta­dos recep­tores das mul­heres migrantes que chegam aos seus territórios por motivações diver­sas e derivadas dos desafios expos­tos à sociedade inter­na­cional. Algu­mas são pas­santes, out­ras refu­giadas de guer­ra e ou políticas, ain­da há as deslo­cadas ambi­en­tais e as eco­nomi­ca­mente hipos­su­fi­cientes. Para tan­to, elen­camos em ambos os doc­u­men­tos inter­na­cionais as beness­es às migrantes em ter­mos de dire­itos e sua conexão com a recep­tivi­dade do Esta­do-parte em razão do Dire­ito Inter­na­cional ou Comunitário e nos vale­mos da metodolo­gia qual­i­ta­ti­va por meio da análise de conteúdo dos trata­dos inter­na­cionais cita­dos.

ABSTRACT: Paler­mo Pro­to­col of 2000 and the Istan­bul Con­ven­tion of 2011 belong to the con­tem­po­rary world and share demo­c­ra­t­ic ideals; there­fore, they deserve an analy­sis from the point of the view of the Inter­na­tion­al Law and the Com­mu­ni­ty Law, in this study, regard­ing the guar­an­tees offered by the receiv­ing States of women migrants, whose come to their ter­ri­to­ries for dif­fer­ent rea­sons and derived from the chal­lenges exposed to inter­na­tion­al soci­ety. Some peo­ple are pass­ing through the ter­ri­to­ry, oth­ers are war or politi­cian refugees and there are the envi­ron­men­tal dis­placed and the eco­nom­i­cal­ly under­fund­ed. For that, we list in both inter­na­tion­al doc­u­ments, the ben­e­fits to women migrants in terms of rights and their con­nec­tion with the recep­tiv­i­ty of the State par­ty due to Inter­na­tion­al or Com­mu­ni­ty Law and we use the qual­i­ta­tive method­ol­o­gy through the con­tent analy­sis of the men­tioned inter­na­tion­al treaties.
