RESUMO: O Brasil aprox­i­ma-se da comem­o­ração dos 200 anos de sua fun­dação políti­ca. Na con­strução de um pro­je­to de desen­volvi­men­to, hoje, sus­ten­táv­el para o Brasil, em sua inserção region­al e inter­na­cional, o Dire­ito tem de desem­pen­har uma função extrema­mente impor­tante, porque é por meio dele que o vocab­ulário das demais ciên­cias tor­na-se efe­ti­vo, por meio de nor­mas e insti­tu­ições. A ordem do espaço públi­co decorre dessa con­ver­são e a inserção da políti­ca no Dire­ito é que per­mite a ele­vação à Democ­ra­cia daqui­lo que o Dire­ito ape­nas con­ce­bia como seu império ou rule of law, e como arcabouço de pro­teção dos impre­scindíveis e inafastáveis Dire­itos Humanos. Cabe ao Dire­ito, como ciên­cia e como práti­ca, tornar efe­tivos ess­es dire­itos fazen­do a con­stante migração entre os espaços inter­na­cional e inter­no, e con­ju­gan­do-os com os imper­a­tivos da par­tic­i­pação efe­ti­va e da rep­re­sen­tação legí­ti­ma, no seio de estru­turas jurídi­cas que façam fluir os sig­nos de uma sociedade políti­ca real­mente democráti­ca.

ABSTRACT: Brazil is approach­ing the 200th anniver­sary of its polit­i­cal foun­da­tion. In the con­struc­tion of a devel­op­ment project, today, sus­tain­able for Brazil, in its region­al and inter­na­tion­al inser­tion, the Law has to play an extreme­ly impor­tant func­tion, because it is through it that the vocab­u­lary of the oth­er sci­ences becomes effec­tive, through stan­dards and insti­tu­tions. The order of the pub­lic space results from this con­ver­sion and the inser­tion of pol­i­tics in Law is what allows the ele­va­tion to Democ­ra­cy of what Law only con­ceived as its empire or rule of law, and as a frame­work for the pro­tec­tion of the indis­pens­able and inex­haustible Human Rights. It is up to the Law, as a sci­ence and as a prac­tice, to make these rights effec­tive by mak­ing the con­stant migra­tion between the inter­na­tion­al and domes­tic spaces, and com­bin­ing them with the imper­a­tives of effec­tive par­tic­i­pa­tion and legit­i­mate rep­re­sen­ta­tion, with­in legal struc­tures that make the signs flow of a tru­ly demo­c­ra­t­ic polit­i­cal soci­ety.
